ALDI VOUCHER TERMS OF SALE
These Terms of Sale set out how we supply the vouchers available through this site to you (respectively our “Site” and our “Vouchers”). They tell you who we are, how we will provide your order to you, how you and we may change or cancel your order, what to do if there is a problem and other important information.

PLACING ORDERS WITH US
- How to place an order. Our Site will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order.
- How we will accept your order. Our acceptance of your order will take place when we e-mail you to accept it, at which point a contract will come into existence between you and us on the basis of these Terms of Sale.
- If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the Vouchers ordered.

VOUCHERS

Terms of Use. Use of the Vouchers is governed by the Terms and Conditions printed on each voucher (details of which will be visible on the Site before the time of purchase). Please in particular note:
- the Vouchers can only be used in participating ALDI Stores in the United Kingdom (and cannot therefore be used on any ALDI websites); and
- no change will be given if the value of a purchase made with a Voucher is less than the amount of the Vouchers used for that purchase.
- Withdrawal of Vouchers: The Vouchers may be withdrawn by ALDI, without liability, in the event that we suspect they are being used fraudulently, illegally, or otherwise in breach of our terms.
- Order restrictions. We reserve the right to limit the number of Vouchers that can be included in an order, or be ordered by any individual user of our Site.
- ResaleWe do not accept orders for re-sale.

Minor changes to your order. We may change the Vouchers you order to:
- reflect changes in relevant laws and regulatory requirements; and/or
- implement minor technical adjustments and improvements.
- More significant changes. In addition to Clause 2.5 above, we may make more significant changes to the Vouchers you order but if we do so we will notify you and you may then contact us to end the contract and receive a refund.

- Who else can you talk to. FULFILLING YOUR ORDER
- Delivery Costs. The costs of delivery will be as displayed to you on our Site. These will be added to the costs of the Vouchers which you are ordering.

Delivery Process. Subject to any delivery restrictions shown on our Site and in these Terms of Sale, delivery will be made:
- to the address specified by you when you place your order; and
- by first class post through the Royal Mail.
Your Vouchers will be considered to be delivered when the Royal Mail completes its own delivery process.
- Delivery Restrictions. We only deliver to England, Wales, Scotland (including the Scottish Highlands), the Shetland Islands, the Isle of Man and the Isle of Wight.
- When we will fulfil your order. We will let you know when we will aim to deliver the order to you, or make it available for you to collect, during the order process. Please note that such delivery times are only estimates and cannot be guaranteed.
- Contacting you about deliveries. We, or the Royal Mail, may contact you to confirm the despatch of, arrange the delivery of, or otherwise discuss, Vouchers which you order from our Site.
- We are not responsible for delays outside of our control. If our fulfilment of your order is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel the order and receive a refund for an order you have paid for but not received.

Your legal rights if we deliver late. You have legal rights if we deliver any Vouchers late. If we miss the delivery deadline for any Vouchers then you may treat the contract as at an end straight away if any of the following apply:
- we have refused to deliver the Vouchers;
- delivery within the delivery deadline was essential (taking into account all the relevant circumstances); or
- you told us before we accepted your order that delivery within the delivery deadline was essential.
- Setting a new deadline for delivery. If you do not wish to treat the contract as at an end straight away, or do not have the right to do so under Clause 4.7 above, you can give us a new deadline for delivery, which must be reasonable, and you can treat the contract as at an end if we do not meet the new deadline.
- Ending the contract for late delivery. If you do choose to treat the contract as at an end for late delivery under Clause 4.7 or Clause 4.8 above, you can cancel your order for any of the Vouchers or reject Vouchers that have been delivered. If you wish, you can reject or cancel the order for some of those Vouchers (not all of them). After that we will refund any sums you have paid to us for the cancelled Vouchers and their delivery. If the Vouchers have been delivered to you, you must either return them to us or allow us to collect them from you. See Clause 6 (Returning Vouchers and Refunds) for details of how to return Vouchers to us.

What will happen if you do not give required information to us.
- We may need certain information from you so that we can supply the Vouchers to you. If this is the case, we will contact you to ask for this information.
- If you do not give us the required information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the contract.
- We will not be responsible for supplying the Vouchers late, or not supplying any part of them, if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
- When you become responsible for and own the contents of your order. You own the Vouchers after they have been transferred during a successful delivery.

YOUR RIGHTS TO CANCEL THE ORDER
- Cancelling an order because your Vouchers are faulty or misdescribed. We are under a legal duty to supply Vouchers that are in conformity with these Terms of Sale. This means Vouchers must be as described, fit for purpose and of satisfactory quality. You can cancel your order if the Vouchers we provide do not meet these standards.

Cancelling an order because of something we have done or are going to do. If you are cancelling an order for a reason set out at Clause 5.2.1 to 5.2.4 below, the contract between us will end immediately and we will refund you in full for any Vouchers which have not been provided. The reasons are:
- we have told you about an upcoming change to the Vouchers or these Terms of Sale which you do not agree to, see Clause 2.7 (More significant changes);
- we have told you about an error in the price or description of the Vouchers you have ordered and you do not wish to proceed;
- there is a risk that supply of your order may be significantly delayed because of events outside our control; and
- you have a legal right to cancel your order because of something we have done wrong.
- Exercising your right to change your mind. You have a legal right to change your mind within 14 days and receive a refund. Nothing in these Terms of Sale affects that legal right of return. This time period begins the day after your Vouchers are delivered.

RETURNING VOUCHERS AND REFUNDS
- How to cancel. If you have the right to cancel the Contract under Clause 5 above then simply contact our Customer Services Team to complete the cancellation and arrange a collection / return of your Vouchers on 0800 042 0800 or using the details in Clause 3.1 (Contacting our Customer Service Team).
- When we will pay the costs of return. We will pay the costs of return if you cancel your order under Clause 5.1 or 5.2. In all other circumstances, you must pay the costs of return.

How we will refund you. Please note:
- we will typically refund you by the method you used to make payment;

where Vouchers are to be returned to us, we may defer any refunds until such point as we have received:
- the returned or rejected Vouchers back from you (which may take up to two weeks); or
- evidence that you have sent the Vouchers back to us; and
- we will send you an e-mail once your refund has been processed; please note refunds may take up to three working days to be shown in your account.
- Deductions from refunds. We may make deductions from refunds if the Vouchers you return have been tampered with, or a successful return has been impeded as a result of your actions.

OUR RIGHTS TO CANCEL YOUR ORDER
- Your order constitutes a binding contract between you and us. We may cancel your order if you breach any of these Terms of Sale. We may cancel your order at any time by notice in writing to you if you do not, within a reasonable time, allow us to deliver your order to you.
- We may withdraw or recall Vouchers. We may write to you to let you know that we are going to withdraw or recall Vouchers because we need to, for example, investigate potential fraud. We will give you as much notice as possible of such a withdrawal or recall. We will refund any sums you have paid in advance for Vouchers which will not be provided.
- We reserve the right to reject and/or cancel any order at any time with or without notice if you are found to be (or we suspect you of) reselling the Vouchers for commercial gain.

PRICE AND PAYMENT
- What happens if we get the price wrong. It is always possible that, despite our best efforts, we may indicate an incorrect price on our Site. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may cancel your order, refund you any sums you have paid and require the return of any Vouchers provided to you.

When and how you must pay.
- We accept payment with Visa Debit, Visa Credit, Maestro, Delta, Electron and MasterCard.
- We will take payment when you click the ‘Pay Now’ option during the order process. This will typically show on your bank statement within 48 hours.
- We reserve the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse or cancel orders depending on the result of these checks.

OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

We are responsible to you for foreseeable loss and damage caused by us. Subject to Clauses 9.2 and 9.3 below, if we fail to comply with these Terms of Sale:
- we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill; but
- we are not responsible for any loss or damage that is not foreseeable.
- We are not liable for business losses. We only supply your order for domestic and private use. If you use your order for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We are not liable for bank charges. We are not responsible for any charges or other amounts which may be applied by your card issuer or bank or payment method provider as a result of:
- our processing of your credit/debit card payment or other method of payment in accordance with your order; or
- us being located in the United Kingdom.

We are responsible to you for foreseeable loss and damage caused by us. Subject to Clauses 9.2 and 9.3 below, if we fail to comply with these Terms of Sale:

HOW WE MAY USE YOUR PERSONAL INFORMATION

- to supply your order to you; and
- to process your payment for your order.
We will not use the personal information which you provide through this Site for marketing purposes.

As stated in the “Privacy for Customers” notice “Shopify will never use your personal information to independently market or advertise to you, unless you are using one of [their] apps or services directly”.

The Site is supported by the “Shopify” platform, and Shopify cookies will be placed on your device when you use the Site. - Main Site. These terms do not apply to products purchased through our main site at https://www.aldi.co.uk/.
- Legal Rights. You may have heard references to the “statutory” or “legal” rights which consumers always have in the United Kingdom. Nothing in these Terms of Sale will affect those legal rights.
- We only sell to the UK. Our Site is solely for the promotion and sale of our Vouchers in the United Kingdom. As such, we do not accept orders from or deliver to addresses outside the United Kingdom.
- Changes to these Terms: We may revise these Terms of Sale at any time by amending this page. Changes to these Terms of Sale will not affect any orders placed before those changes were uploaded to our Site. These Terms of Sale were last updated on 15 April 2020.
- We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms of Sale to another organisation. We, in particular, may engage third-party carriers to deliver, or make available for collection, the Vouchers which you order. Such transfers will not affect your rights under these Terms of Sale.
- You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these Terms of Sale to another person if we agree to this in writing.
- Nobody else has any rights under this contract. These Terms of Sale are not intended to benefit, or be enforceable by, any third party (except as explained in Clause 11.6 above). Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these Terms of Sale.
- The laws which apply to this contract and where you may bring legal proceedings. These Terms of Sale are governed by English law and you can bring legal proceedings in respect of your order in the English courts. If you live in Scotland you can bring legal proceedings in respect of your order in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of your order in either the Northern Irish or the English courts.
